What is APP Filing?

APP filing, namely the filing of mobile internet application, refers to the process where the organizer of an app engaged in internet information services within the territory of mainland China fulfills the filing procedures with the telecommunications regulatory authority in accordance with the requirements of national laws and regulations, registering real-name, network resources, and business information. The purpose of APP filing is to regulate the market order of the mobile internet, protect user rights, and ensure network security.

Who Needs to Apply for APP Filing?

According to the notice issued by the Ministry of Industry and Information Technology on carrying out the work of filing mobile internet applications, organizers of apps engaged in internet information services within the territory of the People's Republic of China shall fulfill the filing procedures in accordance with the provisions of the Anti-Telecommunications Network Fraud Law of the People's Republic of China, Measures for the Administration of Internet Information Services, and other regulations. Those who have not completed the filing procedures shall not engage in APP internet information services. In other words, if your app uses servers or domain names in mainland China and provides internet information services to users within China (including but not limited to news, social networking, e-commerce, games, etc.), you need to apply for APP filing.

When Should APP Filing Be Completed?

According to the notice of the Ministry of Industry and Information Technology, organizers of apps that have already been launched and operated shall complete the first filing between September 1, 2023, and March 31, 2024. Organizers of newly launched and operated apps shall complete the first filing before launching and operating. Failure to complete the first filing on time will be deemed as failure to fulfill the filing procedures. Therefore, if you have not yet completed the APP filing, it is best to start preparing the relevant materials and procedures as soon as possible to avoid missing the deadline.
