II. Work Content
(1) The sponsors of mobile applications (APP) engaged in Internet information services within the territory of the People's Republic of China shall, in accordance with the provisions of the "Anti-Telecommunications Network Fraud Law of the People's Republic of China" and the "Administrative Measures for Internet Information Services" (State Council Decree No. 292), fulfill the filing procedures. Those who have not fulfilled the filing procedures shall not engage in Internet information services through APP.
(2) The Ministry of Industry and Information Technology supervises and guides the national APP filing work, and the provincial, autonomous region, and directly-administered municipality telecommunications management bureaus are responsible for implementing the supervision of APP filing management work.
(3) The network resources such as domain names and IP addresses used by APP sponsors shall comply with the management requirements of the "Measures for the Administration of Internet Domain Names" (Ministry of Industry and Information Technology Decree No. 43), the "Measures for the Administration of Internet IP Address Filing" (former Ministry of Information Industry Decree No. 34), and the "Notice of the Ministry of Industry and Information Technology on Standardizing the Use of Domain Names for Internet Information Services" (MIIT Information Management [2017] No. 264).
(4) APP sponsors shall truthfully fill out the "Internet Information Service Filing Registration Form" (hereinafter referred to as the "Filing Registration Form") and relevant commitment documents.
(5) APP sponsors shall fulfill the filing procedures with the provincial-level telecommunications management bureau where their domicile is located, and their network access service providers and APP distribution platforms (hereinafter referred to as distribution platforms) shall use the "National Internet Basic Resource Management System" (referred to as the filing system) to submit applications online and conduct verification and review.
(6) Network access service providers and distribution platforms shall verify the real identity and network resources information of users or organizations intending to engage in APP Internet information services and shall not act on behalf of them to fulfill the filing procedures when they know or should know that the information is inaccurate.
(7) After receiving the filing materials submitted by the APP sponsors, if the materials are complete and accurate, the provincial-level telecommunications management bureau shall complete the filing within twenty working days, issue a filing number, and publish the filing information to the public through the filing system. Incomplete or inaccurate materials shall not be filed, and the reasons shall be explained.
(8) APP sponsors shall prominently display their filing numbers in the APP and link to the filing system website as required for public inquiry and verification. Distribution platforms shall prominently display the filing number information of the distributed APP and submit relevant information to the telecommunications regulatory authorities.
In case of changes or deregistration of APP information, the APP sponsors shall fulfill the procedures for changes or deregistration with the original filing authority.
(9) Network access service providers, distribution platforms, and smart terminal manufacturing enterprises shall not provide network access, distribution, or pre-installation services for APPs that have not fulfilled the filing procedures.
(10) APP sponsors, network access service providers, distribution platforms, and smart terminal manufacturing enterprises shall establish and improve mechanisms for monitoring and dealing with illegal and irregular information. If information prohibited from being published or transmitted by laws and administrative regulations is found, transmission of such information shall be immediately stopped, and measures such as removal shall be taken to prevent the spread of information, relevant records shall be preserved, and reports shall be made to the telecommunications regulatory authorities and disposed of in accordance with the requirements of the telecommunications regulatory authorities.
